Terms & Conditions of Hire

These Terms and Conditions set out below shall be the basis of all contracts of hire with Nymrod Comms by any person(s) or corporate body and the handing over of goods by Nymrod Comms on the basis of such rental agreement.

Nymrod Comms is a trading name used by Nymrod Ltd, (Company Registration No. 09927715). Registered in England & Wales at Unit 2 Beacon Business Park, Farningham Road, Crowborough, East Sussex, TN6 2GD, United Kingdom.

We reserve the right to amend these Terms and Conditions at any time. The Terms and Conditions applying to your hire will be those in place on the date that you make your reservation.

EQUIPMENT

The hirer will satisfy themselves on taking possession of the equipment that it is in good working order and in an undamaged condition.

All equipment on hire remains the absolute property of Nymrod Comms. The hirer shall have no authority to transfer or otherwise part with possession of the equipment during the period of hire unless the express written consent of Nymrod Comms is first obtained.

If the hirer intends to take equipment outside of England, Scotland or Wales then consent must first be obtained from Nymrod Comms who may at their sole discretion vary the terms of the rental.

Nymrod Comms accepts no responsibility for advice provided on the suitability of its equipment, nor does it warrant, guarantee or promise that any advice given by its employees or agents on the suitability of hire equipment may be accurate.

LOSS OR DAMAGE TO EQUIPMENT

It shall be the absolute responsibility of the hirer to ensure the safe keeping of equipment and the hirer will indemnify Nymrod Comms in respect of any loss or damage howsoever caused whilst in the hirer’s possession.

Any damage or loss to equipment will be notified to Nymrod Comms immediately (or as soon as practicable) following which the goods must be returned to Nymrod Comms for repair, or, replacement should repair not be possible or uneconomical. The hirer shall not undertake repairs to equipment unless express consent from Nymrod Comms has been received and shall otherwise make no attempt to examine, diagnose, repair or remove the outer casing of the equipment hired.

The hirer shall be liable to pay the full retail cost of replacement of any equipment lost or damaged beyond repair with reference to new equipment of the same or nearest available specification.

In the event of loss or damage to equipment, the period of hire will without further reference to the hirer extend until full reimbursement for the cost of replacement of the lost or damage equipment has been made whether such period extends beyond that of the original rental agreement.

DELIVERY & COLLECTION

Standard deliveries and collections made by a third-party courier take place between 08:00 and 18:00 Monday to Friday. Nymrod Comms endeavour to deliver all equipment within one consignment, by one courier, the working day prior to the on-hire date. The hirer shall notify Nymrod Comms immediately (or as soon as practicable) of any damaged or missing equipment. Dates quoted for delivery and collection are to be treated as an estimate, and the hirer acknowledges that delivery and/or collection may be postponed due to circumstances outside the direct control of Nymrod Comms.

It is the hirer’s responsibility to ensure someone is available at the delivery address to sign for the equipment. In the event the courier is unable to deliver the equipment, they will attempt another delivery on the following working day.

Equipment must be ready and available at the collection address the working day after the off-hire date. If the courier is unable to collect the equipment on the specified date, the hirer will be responsible for a £12.50 failed collection fee and any costs resulting from the extension of the hire period. Refunds for early return of equipment will not be provided.

IDENTITY CHECKS

Nymrod Comms will perform a confidential identity verification check on all new hirer’s for the purposes of fraud and theft prevention. All personal information will be processed securely as outlined in the Privacy Policy. Nymrod Comms may ask the hirer to supply documents to assist in the verification process. A soft-search credit check may also be performed on the hirer and should not leave a footprint on the hirer’s credit report.

Nymrod Comms reserves the right to cancel a hire where they are not satisfied with the validity of the identity documents provided and/or, if the company believes there is an elevated risk of providing equipment to the hirer. Nymrod Comms is not obliged to provide an explanation in the event of cancellation and all personally identifiable documents will be securely destroyed and any monies paid will be refunded to the hirer.

PAYMENT

Quotations, proposals and provisional bookings do not constitute a contract or guarantee the availability of any equipment. Hires are not confirmed or guaranteed until the hire charge has been paid in full. Equipment will not be despatched by Nymrod Comms until all hire charges have been paid in full by the hirer.

Unless stated elsewhere, all prices are displayed exclusive of VAT at the prevailing rate.

DEPOSIT

A refundable security deposit will be payable by the hirer the working day before dispatch. This deposit will be refunded to the original payment method within 3 working days of Nymrod Comms receiving the hire equipment back from the hirer in the original, working condition as supplied. Refunds may take up to 10 working days to clear the hirer’s account.

CANCELLATION

Equipment hires cancelled by the hirer within 3 working days of the on-hire date, will be subject to a cancellation charge of 50% of the total hire charge.

The security deposit will be refunded in full, in the event of cancellation by either Nymrod Comms or the hirer.

LIABILITY

Nymrod Comms shall not be liable under any circumstances whatsoever for losses incurred by the hirer due to faulty or non-functioning equipment during the period of hire. Nymrod Comms will however, take all steps to ensure that faulty equipment is replaced as soon as possible with either the same or similar specification equipment.

The hirer will indemnify Nymrod Comms at all times against liabilities, demands, actions, claims or proceedings arising from or in connection with the equipment hired.

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
